Richard Berryhill
ABOUT
Mr. Berryhill is an experienced worker’s compensation defense attorney with a demonstrated history of working in the legal services industry. He came to Hanna Brophy in June 2018. Mr. Berryhill’s legal career includes a wealth of experience as a workers’ compensation defense attorney, which he has practiced since 1990. He enjoys research, appeals, and writs. He successfully overturned an en banc decision of the Board following the passage of SB899 in the case of Rio Linda Union School District (Scheftner). The California Applicant’s Attorney’s Association appealed to the California Supreme Court but lost. This case determined that apportionment applied retroactively to all workers’ compensation cases still in the system. He has successfully overturned other Board decisions as well and maintains a large data base of case law, briefs, and white papers.
Mr. Berryhill also represents employers in workers’ compensation defense of both discrimination claims and serious and willful claims brought under the Labor Code as well as OSHA violations. He has also practiced subrogation in both workers’ compensation and general insurance areas as well as insurance coverage litigation. He was previously an arbitrator for the American Arbitration Association in the Construction Defects and Personal Injury sections and has been a judge pro-tem in juvenile court. He practices in all state and federal courts in the State of California, including Bankruptcy Court.
Before focusing solely on workers’ compensation defense, Mr. Berryhill defended cities, supermarket chains, and practiced business and real estate litigation.
